TERMS & CONDITIONS

1. Promoter

The promoter is Frank and Tina Micali Pty Ltd (ABN 58 423 199 219), trading as Franky & Co (“Franky & Co” or “the Promoter”), of Unit 4, 8 Millennium Ct, Silverwater NSW.

2. Promotion Period

The Franky & Co 10th Birthday Giveaway commences at 12:00am AEDT on Wednesday, 4 November 2026 and closes at 11:59pm AEDT on Friday, 4 December 2026 (“Promotion Period”). Entries received outside the Promotion Period will not be accepted.

3. Eligibility

Entry is open to NSW residents aged 18 years and over. Employees, directors and management of Franky & Co, its related entities and participating Franky & Co stores, and any person directly involved in conducting the promotion or determining the winners, are not eligible to enter.

4. How to Enter

Entry is available with any purchase made at a participating Franky & Co store during the Promotion Period. No additional entry fee applies.

To enter, eligible entrants must, during the Promotion Period:
1. Make any purchase at a participating Franky & Co store in NSW;
2. Visit the official competition webpage at https://frankyandco.com.au/pages/franky-co-giveaway (including by scanning the QR code on promotional materials);
3. Follow the official Franky & Co VIP WhatsApp Channel, accessible using the button on the competition webpage;
4. Complete and submit the official competition entry form on the competition webpage, including confirming that they made an eligible purchase during the Promotion Period and that they follow the VIP WhatsApp Channel; and
5. Agree to these Terms & Conditions.
The entry form and WhatsApp Channel button may be accessed in either order. Joining the Channel alone does not constitute an entry; the completed entry form must be submitted during the Promotion Period.

Entrants are not required to upload a receipt when submitting their entry. However, the Promoter reserves the right to request reasonable proof of purchase where required to verify the validity of an entry. The Promoter may also request reasonable information to verify compliance with the WhatsApp Channel requirement, subject to applicable law and the technical limitations of WhatsApp Channels. Limit of one entry per person, regardless of the number of purchases made during the Promotion Period. Only completed and valid entries received during the Promotion Period will be included in the prize draw.

5. Prizes

There are 10 prizes to be won. Each winner will receive 1 × NINJA ES601 Luxe Café Espresso Coffee Machine (Gunmetal) valued at RRP $849.99. There will be 10 individual winners, with each winner receiving one coffee machine. Total prize pool: $8,499.90. A person may win a maximum of one prize. Prizes are not transferable, exchangeable or redeemable for cash. If a specified prize becomes unavailable for reasons outside the Promoter’s reasonable control, the Promoter reserves the right to substitute it with a prize of equal or greater value, subject to applicable law.

6. Prize Draw

This promotion is a game of chance. Skill plays no part in determining the winners. The prize draw will take place on Monday, 7 December 2026 at Franky & Co Head Office, Silverwater NSW. All valid entries received during the Promotion Period will be entered into the draw. The 10 winners will be selected at random from all eligible entries. Once an entrant has been selected as a winner, that entrant will be removed from subsequent draws so that 10 different winners are selected. The Promoter’s decision regarding the conduct of the draw and eligibility of entries is final, subject to applicable law.

7. Winner Notification

Winners will be contacted using the contact details provided on their competition entry form. The Promoter will make reasonable attempts to contact each winner. Winners may also be announced through Franky & Co’s website, social media accounts and/or VIP WhatsApp. Before awarding a prize, the Promoter may require a winner to provide reasonable proof of identity, age, NSW residency and compliance with these Terms & Conditions.

8. Claiming a Prize

Winners must respond to the Promoter and claim their prize within 14 days of being notified. The Promoter will provide each winner with instructions regarding collection or delivery of their prize. Any costs not expressly included as part of the prize are the responsibility of the winner.

9. Unclaimed Prizes

The Promoter will make reasonable efforts to contact each winner. If a winner cannot be contacted, does not claim their prize within 14 days of notification, is found to be ineligible or has not complied with these Terms & Conditions, that winner may forfeit the prize. Where a prize is forfeited, the Promoter may conduct a further random draw from the remaining eligible entries to determine a replacement winner. Any replacement winner will be contacted using the details supplied with their entry and will be subject to these Terms & Conditions.

10. Verification and Invalid Entries

The Promoter reserves the right to verify the validity of entries and entrants. The Promoter may disqualify an entrant who submits incomplete, inaccurate or fraudulent information; submits more than the permitted number of entries; tampers with or attempts to manipulate the entry or draw process; does not satisfy the eligibility or entry requirements; or otherwise breaches these Terms & Conditions. Automated, computer-generated, fraudulent or otherwise manipulated entries will be invalid.

11. Privacy

Personal information collected as part of this promotion will be used by Franky & Co for the purpose of administering the competition, verifying entries, contacting winners and awarding prizes. Where an entrant separately consents to receive marketing communications, Franky & Co may also use their information for that purpose in accordance with applicable privacy and marketing laws. By joining the Franky & Co VIP WhatsApp, entrants acknowledge that their use of WhatsApp is also subject to WhatsApp’s own terms and privacy practices.

12. WhatsApp, Meta and Ninja Disclaimer

This promotion is conducted by Franky & Co. It is not sponsored, endorsed, administered by or associated with WhatsApp or Meta. Ninja is the brand of the prize being awarded. Unless expressly stated otherwise, this promotion is not sponsored, endorsed, administered by or associated with Ninja or its related entities. Entrants release WhatsApp and Meta from any liability arising from or in connection with this promotion to the extent permitted by law.

13. General

The Promoter accepts no responsibility for entries that are lost, delayed, incomplete, incorrectly submitted or not received due to technical problems or circumstances outside the Promoter’s reasonable control. If the promotion cannot proceed as planned because of circumstances outside the Promoter’s reasonable control, the Promoter may modify, suspend, postpone or cancel the promotion where reasonably necessary, subject to applicable law. Nothing in these Terms & Conditions excludes, restricts or modifies any consumer rights or guarantees that cannot lawfully be excluded under the Australian Consumer Law. The Promoter may amend these Terms & Conditions where reasonably necessary. Any material changes will be communicated or made publicly available as required by applicable law. Participation in the promotion constitutes acceptance of these Terms & Conditions.
